6 Ways to Control Attorney Fees and Costs.

Understanding the full cost of legal representation, especially in complex cases like divorce or criminal cases, can be intimidating.  It is shocking to discover the initial retainer paid may not cover all attorney fees and expenses, including potentially costly additions like expert fees. The uncertainty surrounding the potential cost of your divorce or criminal defense matter can significantly influence your decision to seek legal representation or who you may retain.

The following six recommendations are designed to allow you to remain in control of the costs charged in your criminal or divorce case while still benefiting from professional legal assistance.

  1.  Request a Litigation Budget. A litigation budget is an outline of mandatory trial related work and estimated costs.  For example, in a divorce matter, this would be the cost to take the matter to a permanent order hearing. In a criminal defense matter this may include the time for preparation of questioning the state’s witnesses and any necessary experts.

  2. Request a Cost / Benefit Comparison.  This is different than a litigation budget as it deals with case work that may be advised by your attorney but not mandatory trial related work.  For example, in a divorce case, your attorney might propose extra discovery.  You can discuss its benefits, impact, and estimated cost.  By assessing cost-effectiveness, you retain control over expenses, deciding whether to proceed with suggested action.

  3. Prepare an Agenda for Meetings. Before scheduling an appointment with your attorney, take the time to outline an agenda detailing what topics you wish to discuss and any questions you may have.  This will allow a more focused and efficient discussion, which translates to reduced time billed to you.

  4. Consolidate Questions and Issues. Compose and send emails only after identifying all issues and questions. This reduces attorney/staff response time and minimizes billed hours.

  5. Get a Good Therapist.  Avoid unnecessary legal fees by discussing the stress a case is having on you with a good therapist.

  6. Prompt Response Encouraged.  Respond promptly to any requests for additional information or clarification from your attorney or their staff. This minimizes duplicated efforts and ensures the smooth progression of your case.

Maintaining control over attorney fees is paramount.  By implementing proactive strategies, you can mitigate unnecessary expenses in your matter. Ultimately, by taking an active role in managing case expenses, you can achieve a better balance between the cost of the case and the result you are seeking.
